1. Agreement to Terms
By accessing or using LumaOne's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services.
2. Company Information

3. Service Description
LumaOne is a managed software service that provides an AI-powered receptionist for small and medium-sized businesses. Our platform designs and maintains natural language call handling workflows that can answer common questions, qualify inbound leads, schedule appointments, and seamlessly transfer calls to human team members when necessary.
The product is delivered digitally, with no physical goods. Billing is subscription-based with service tiers that include configuration, ongoing optimization, analytics access, and support.
4. NOT a Telecommunications Provider
Important Notice:
LumaOne is NOT a telecommunications provider. We do not provide, sell, lease, or manage phone numbers, telephone lines, or telecommunications services of any kind.
Customers continue to use their existing phone numbers and carriers (e.g., Telnyx, Twilio, their VoIP/PBX system, or their current phone service provider). LumaOne only provides the AI conversation layer, configuration, integrations, monitoring, and ongoing support.
You are solely responsible for obtaining, maintaining, and paying for your own telecommunications services and phone numbers from your chosen telecommunications provider.
5. Customer Requirements
To use LumaOne services, you must:
- Have an existing phone number from your telecommunications provider
- Have the ability to forward or route calls from your phone number to our AI service
- Maintain active telecommunications service with your provider
- Ensure compliance with all applicable telecommunications regulations in your jurisdiction
- Provide accurate business information and maintain valid payment methods
6. Payment Processing and Merchant of Record
All payment processing, billing, and subscription management is handled by a third-party payment processor who serves as the Merchant of Record for all transactions. Your payment information is processed securely through our payment processor and is never stored on LumaOne servers.
The payment processor handles all billing inquiries, subscription management, refunds, and payment disputes. Transaction details, including the specific payment processor used, will be displayed during checkout and on your invoice.
7. Subscription Plans and Billing
Subscription plans renew automatically on a monthly basis. Billing includes:
- Monthly subscription fee based on your selected tier
- One-time setup fee (if applicable)
- Usage-based charges for minutes, SMS, or additional agents beyond plan limits
All charges are billed in advance at the beginning of each billing period. Overage charges for usage beyond plan limits are billed monthly in arrears. Payment is due immediately upon invoice.
8. Acceptable Use Policy
You agree to use LumaOne services only for lawful business purposes. Prohibited uses include:
- Telemarketing or cold calling without proper consent and compliance
- Fraudulent activities or misrepresentation
- Harassment, threats, or abusive behavior
- Violation of local, state, federal, or international laws
- Transmission of illegal, harmful, or objectionable content
- Attempts to compromise, reverse engineer, or interfere with our service
We reserve the right to immediately suspend or terminate service for violations of this policy without refund.
9. Service Level and Availability
We target 99.5% uptime for our AI conversation services. Response handling typically occurs within 3 seconds of call connection. In the event of service disruptions, we will make commercially reasonable efforts to restore service promptly.
Service availability is subject to your telecommunications provider's uptime and call routing capabilities. LumaOne is not responsible for outages or failures caused by your telecommunications provider or internet connectivity issues.
10. Data and Privacy
We process call data, conversation transcripts, and business information in accordance with our Privacy Policy. You retain ownership of your business data and conversation recordings. We use this data solely to provide and improve our services.
You are responsible for obtaining necessary consents from callers for call recording and processing where required by applicable law.
11. Cancellation and Termination
You may cancel your subscription at any time by providing 30 days written notice. Cancellation takes effect at the end of your current billing period. No refunds will be provided for partial months or unused services.
Setup fees are non-refundable. Upon cancellation, you will retain access to call transcripts and analytics for 90 days, after which all data will be permanently deleted unless otherwise required by law.
We reserve the right to suspend or terminate your account immediately for violations of these Terms of Service, non-payment, or fraudulent activity.
12. Limitation of Liability
LumaOne is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We are not liable for:
- Missed calls due to telecommunications provider failures or internet connectivity issues
- Booking errors, scheduling conflicts, or calendar synchronization problems
- Lost revenue, business interruption, or consequential damages
- Errors in AI interpretation or conversation handling
- Data loss resulting from your failure to maintain backups
Our total liability is limited to the amount you paid for services in the three months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless LumaOne, its operators, and affiliates from any claims, damages, or expenses arising from your use of our services, violation of these terms, or violation of any rights of third parties.
14. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of our services after changes become effective constitutes acceptance of the modified terms.
15. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction in which LumaOne operates, without regard to conflict of law principles.
